Terms and Conditions

  1. The Consumer Representative warrants that he/she has the capacity and expertise to perform
    the Consumer Representative Services and comply with this Agreement.The Consumer Representative agrees to provide the Consumer Representative Services professionally with all appropriate care, diligence, skill and in accordance with relevant Mater policies and procedures.
  2. REMUNERATION – Remuneration for services will be provided as per the recommendations set-out in the Mater Consumer and Community Engagement Framework.
  3. CONFIDENTIALITY and PRIVACY – The Consumer Representative acknowledges and agrees to comply with his/her obligations under the Australian Privacy Principles (APPs) established pursuant to the Privacy Act 1988 (Cwth). Both parties agree that the terms and conditions of this Agreement are confidential between them. Further, the Consumer Representative agrees that the following shall be “confidential information” for the purposes of this Agreement:
  4. All information, documentation, data, reports, studies and material of any nature provided by Mater to the Consumer Representative for the purposes of this Agreement;
  5. All documentation and material of any nature produced as a result of the carrying out of the Consumer Representative Services; and
  6. Any other material nominated by Mater to be confidential.
    • The Consumer Representative warrants and agrees that it shall not without the consent in writing of Mater disclose to any third party, including via social media sites, any confidential information.
  7. CONFLICT OF INTEREST – The Consumer Representative warrants that, to the best of the Consumer Representative’s knowledge, information and belief, no conflict of interest exists or is likely to arise in the performance of the Consumer Representative’s obligations under this Agreement. If during the currency of the Agreement, a conflict or risk of conflict of interest arises (including without limitation, because of work undertaken for any person other than Mater) the Consumer Representative undertakes to notify Mater immediately in writing of that conflict of interest.  Mater may in these circumstances terminate this Agreement by notice in writing to the Consumer Representative.
  8. TERMINATION – Mater may, at any time and without any reason being given terminate the Mater Consumer Community and/or your participation in this community and program.

OPERATIONAL REQUIREMENTS – The Consumer Representative shall comply with all operational requirements of the Mater in providing the Consumer Representative Services, including Workplace Health and Safety requirements and legislation, and any particular operational requirements of the Mater made known to the Consumer Representative.  The Consumer Representative acknowledges that some of the Consumer Representative Services may be required to be carried out in hospital areas or sensitive areas, and that the Mater may issue particular instructions for the carrying out of those Services.  The Consumer Representative and its representatives shall comply with any security requirements of the Mater.
  10. OCCUPATIONAL HEALTH & SAFETY – General Occupational Health & Safety Requirements
    • The Mater is obligated to provide and maintain, so far as is reasonably practicable, a working environment for its workers and members of the public, that is safe and without risk to health.As a condition of this agreement, the Mater requires that any Consumer Representative that may be engaged to perform a service on its behalf will at all times identify and exercise all necessary precautions for the health and safety of all persons including Consumer Representatives, Mater employees and members of the public who may be affected by the services.
